FAQ

Title transfer questions

Who pays which tax?

By default the seller pays Capital Gains Tax; the buyer pays Documentary Stamp Tax, transfer tax and Registry of Deeds fees. If you've agreed otherwise, tell us and we'll follow it.

Do I need to be there?

No. With a notarized SPA we can act for you, including for OFWs. Apostille or consularize it if you sign abroad.

Is a condo different from land?

The process is the same. Some condos and subdivisions need a developer or admin clearance, which we'll get as part of the process.

What if the buyer or seller is a company?

We'll need a Board Resolution or Secretary's Certificate, the company TIN and the authorized signatories' IDs.

What slows things down?

Unpaid real property tax, name or data mismatches, missing documents, manual records at the Registry of Deeds, or late tax filings. We flag these early.
